Madhya Pradesh High Court Cancels Anticipatory Bail in Twisha Sharma Case

The Madhya Pradesh High Court , on Wednesday, just cancelled the anticipatory bail that had been granted to Giribala Singh . She’s the mother-in-law of Twisha Sharma , and this happened in connection with Twisha’s death .

Giribala Singh had actually gone to a Bhopal sessions court asking for pre-arrest bail. Just two days after Twisha was found dead at her home, May 12th.

Vacation judge Devnarayan Mishra , reading the 17-page order, basically said the lower court missed some huge material facts. He pointed out that things like the WhatsApp chats and what Twisha’s family members were saying weren’t properly considered.

“From those chats,” the High Court noted, “you can’t just say the allegations are only against Samarth Singh .” It seems the lower court overlooked a lot of crucial stuff when it gave that bail.

The High Court quashed the May 15th order from the 10th Additional Sessions Judge in Bhopal. The reasoning was that the allegations against Giribala Singh needed much deeper looking. Sections 80(2), 85 and 3(5) of the Bharatiya Nyaya Sanhita , plus the Dowry Prohibition Act , all demanded serious scrutiny.

It was admitted that Twisha had actually ended her pregnancy. The court looked at what her family said. It observed that both Giribala Singh and her son, Samarth Singh , allegedly harassed Twisha . They pressured her into terminating the pregnancy.

The postmortem report mentioned hanging by ligature as the cause of death. But it also found six other injuries on Twisha Sharma’s body. Four on her left arm, one on a finger, and another on her head. These were all injuries that happened before death.

The court then looked at the subsequent query report. It clarified that these injuries weren't caused while removing the body or during the trip to the hospital. Still, it just opened up more questions in the case.

Meanwhile, things moved on the police side. A Bhopal court sent Samarth Singh into the custody of the Central Bureau of Investigation, the CBI. Later that same day, CBI officials, Samarth Singh along with them, went to Giribala Singh’s place in the Katara Hills area. They were investigating.

The CBI formally took over the case on Monday. They re-registered the FIR that the Madhya Pradesh Police had filed earlier. Both Samarth Singh and Giribala Singh were named as accused.

Senior advocate Anurag Shrivastava , who was representing Twisha’s family, reacted strongly to the High Court’s decision. He said, “Finally, justice is done in the Twisha case.”

He pushed for Giribala Singh to cooperate with the investigators. He suggested, “Since Giribala had been in judicial service for thirty-six years, if she has any respect for the law, then wisdom should take over. She should just surrender before the CBI.”
