Mumbai Court Grants Temporary Bail for NEET Retest Amid Rape Charges

A special court in Mumbai decided something about temporary bail. It granted four days to an eighteen-year-old man who is currently locked up for rape charges . The reason? He needs to be allowed to appear for a NEET retest scheduled for June 21st.

This order came down on Thursday, handed by Special Judge S R Sharma. The accused is lodged at Taloja Central Prison in Navi Mumbai.

But there were conditions attached. The survivor the victim gave no objection, but the bail comes with a serious caveat: he cannot defame or threaten her family while he’s out. That was the main hurdle cleared.

The court set the window from June 18th to June 21st for this release. The bond amount is fifty thousand rupees, and that has to be backed up by an equal surety.

There was also a directive about surrender. He has to report back to the authorities by 2 pm on June 22nd. That’s just one day after the re-examination date. A tight timeline, you know?

The charges themselves are heavy. The man is facing trouble under both the Bharatiya Nyaya Sanhita and the old POCSO Act of 2012 .

Defense counsel Kapil Vishwas Zodge pushed back immediately. He argued that the system should focus on rehabilitation. He suggested this young man needed a chance to take the medical entrance exam, framing it as correcting his past actions. He also worried about how police escort would affect his mental state while preparing for the test.

The prosecution, however, had a different angle. Special Public Prosecutor Chaitrali Panshikar pointed out the sheer gravity of the allegations. He argued strongly against granting this temporary freedom. Instead, he suggested something more measured: perhaps just one day under police escort for the exam.

The court looked at the paperwork submitted the higher secondary certificate and the provisional NEET admit card that the defense provided. The judge noted there were "perspicuous valid grounds" to grant the bail. It acknowledged that the concerns raised by the prosecution could be handled through specific conditions imposed on him.

While relief was granted, the restrictions were strict. He’s explicitly barred from contacting the victim. Tampering with any evidence is off the table. Influencing witnesses? Absolutely not.

He was also ordered to submit an undertaking. This means he has to promise he will show up for the exam and provide proof of attendance when he surrenders. It's a complicated arrangement, this whole thing.
