Congress Leaders Challenge EC Over Meenakshi Natarajan's Nomination Rejection

A group of top Congress leaders approached the Election Commission this Wednesday. They were challenging why Meenakshi Natarajan’s nomination papers had been rejected for Rajya Sabha elections. They pushed hard, calling the decision completely egregious , blatant , patently unlawful .

The delegation included names like K C Venugopal, Randeep Surjewala, Jairam Ramesh, Deepa Dasmunshi, Vivek Tankha, Abhishek Manu Singhvi, and Meenakshi Natarajan herself. They argued that the Returning Officer’s choice was based on something legally shaky. A legally untenable premise, they insisted.

There is no criminal case against Natarajan, according to the party. No court has even acknowledged a private complaint cited in her papers as the basis for rejection. That’s what they said.

Later, after meeting the EC, Abhishek Manu Singhvi spoke at a press conference. He claimed the whole thing came down to a simple misconception.

“The real issue,” he stated, “was the idea that some criminal case was pending against her. She didn't reveal it on the form.” There was an irony there, he said. No actual criminal case exists in law; nothing is established. She couldn't have disclosed something that wasn't there.

He maintained that a private complaint doesn't automatically equal a real criminal case. That needs a court to actually take notice of it before anything else happens.

The argument went deeper into the process. He pointed out that in a private complaint, anyone can file one against anyone. But nothing becomes a criminal matter until some magistrate or judge officially takes cognizance.

At most, what happened was a notice was sent to Natarajan. The decision on taking cognizance had yet to be made after she heard the proceedings. So where did this idea of a criminal case come from? Singhvi asked that question pointedly.

The Congress group then pressed the Election Commission. They wanted the EC to use its power, to restore what they called a level playing field in the election process. It felt like something essential was being ignored.

They had sent detailed representations to the EC before this. The rejection, they argued, was based on the lack of even cognisance. Meaning no criminal case existed that she could have disclosed.

Singhvi insisted the EC has the power to fix wrongs and do justice. They hoped it would see that denying this right created a deeply uneven playing field. It struck at democracy’s core. They demanded an immediate decision.

The Returning Officer's order, Singhvi described it sharply. Egregious . Blatant . Lawless. It had to be set aside immediately.

The rejection itself undermined the whole democratic procedure. Eliminating a candidate before any contest started. That was seen as against the Constitution and its principles. A non-level playing field right at the start.

“You removed someone from the race,” he argued. “So there is no election at all.” He felt this mistake was foolish.

Singhvi hoped the EC would step in fast. There was still time for fixing things, especially since the deadline for withdrawing nominations was also approaching. No one should be denied the right to nominate for the Rajya Sabha in this way, he stressed.

The whole situation circled back to Natarajan’s nomination for a seat from Madhya Pradesh. The EC rejected it because objections were raised about some pending “case” she hadn't disclosed on her papers.

That case? It was reportedly hanging out in Telangana court. A complaint came forward, initiated by a senior BJP leader and a Madhya Pradesh minister named Kailash Vijayvargiya.

The claim was that Natarajan failed to mention this pending issue from Telangana in the affidavit accompanying her nomination documents. That's why the papers got rejected.
